Do You Qualify for Portugal’s IFICI Tax Regime?

The 20% income-tax rate is tied to specific jobs and employers, including recognised research organisations and certified startups.

Portugal’s IFICI regime taxes qualifying employment and self-employment income at 20% for eligible new tax residents. Eligibility links your work and qualifications to a specific type of employer or investment. Before applying, identify that route with the organisation you work for.

What is IFICI, and who can apply?

The legal name is Incentivo Fiscal à Investigação Científica e Inovação, the tax incentive for scientific research and innovation. Article 58-A of the Tax Benefits Statute governs it. ‘NHR 2.0’ is a nickname, not its legal name.

You must become Portuguese tax resident after five preceding years without Portuguese tax residence. Portuguese citizens can qualify. Previous use of the non-habitual resident regime excludes you, and IFICI cannot be combined with the former-resident relief in article 12-A of the IRS Code. The incentive can be used only once.

Which jobs and employers qualify?

Ask your employer which IFICI route it qualifies under before applying. Universities, certified startups and exporting companies follow different requirements. The table identifies the work covered and the organisation responsible for confirming each route.

  • Teaching and research. FCT, the Foundation for Science and Technology, verifies eligible higher-education teaching and scientific research in the national science system. The route also covers specified recognised technology and innovation centres.
  • Contractual productive investment: qualified jobs, normally requiring at least qualification level 5, and governing-body members in entities with the relevant contractual investment benefits. AICEP, the investment and trade agency, checks this route.
  • Highly qualified professions: a listed occupation plus a doctorate, or a bachelor's/master's degree and three years of documented professional experience. The company must meet either the RFAI investment route or the eligible-activity/export route. The Tax and Customs Authority, AT, is responsible.
  • Activities recognised as economically relevant: listed qualified jobs, generally with at least level 5 qualifications, or governing-body roles in recognised businesses. AICEP handles companies with at least €75 million of consolidated turnover in the previous year and PIN/PII investment projects. IAPMEI, the business support agency, handles the other cases.
  • Business research and development: your personnel costs must qualify under SIFIDE, the business R&D tax incentive. The National Innovation Agency, ANI, checks the work and project. A research job title alone is insufficient. AT specifies at least secondary education and direct research and development duties.
  • Certified startups: the business needs formal recognition under Law 21/2023. Startup Portugal verifies this route. The statute includes jobs and governing-body members, while AT's summary describes employee roles directly involved in research or innovation. Get confirmation for a non-research role rather than assuming every startup employee qualifies.
  • Azores and Madeira: the statute provides a regional route subject to regional legislation. Living on an island alone is insufficient. Residents can also use the national routes if their conditions are met.

Confirm your occupation code and the organisation’s evidence with the authority named in the result.

Is your occupation on the highly qualified list?

The highly qualified route in article 58-A(1)(c) uses Portugal’s occupational classification, known as CPP. It covers company chief executives and managing directors under code 112, administrative and commercial directors under 12, and production and specialist-service directors under 13, excluding 1349.

It also covers physical science, mathematics, engineering and related professions under code 21, excluding group 216. Industrial and product designers are included separately under 2163.1. Doctors use code 221, higher-education teachers 231 and ICT professionals 25.

The CPP code follows the duties of the job. The exclusions matter for architects, whose group 216 is largely left out of this route. Some finance, creative and technical occupations appear instead in the separate economically relevant activity list.

The RFAI investment branch also has a provision for company administrators, managers and general directors. Their application follows that provision’s requirements rather than the qualification test for other employees.

Does the company need to export 50%?

Only the export branch imposes this particular threshold. It requires at least 50% of turnover from exports in the year you start the job or either of the two preceding financial years. AT says intra-EU sales count.

The company's principal activity must also fall within the specified CAE business codes. The regulation refers to revision 3: mining 05–09, manufacturing 10–33, information and communication 58–63, natural-science R&D 721, higher education 85420 and human health 86100–86904. Have the company check the legal mapping if its registration now displays a newer CAE code.

The alternative RFAI branch concerns companies with qualifying investments in the starting year or the previous five financial years. RFAI means Regime Fiscal de Apoio ao Investimento, an investment tax relief. It does not impose the export branch's 50% test. Neither branch is established merely by having overseas clients.

Can a self-employed person qualify?

Self-employment falls within IRS category B, which the regime can cover. Your activity and the organisation through which you perform it must still satisfy one of the statutory routes.

For a self-employed applicant, AT asks for the tax numbers and qualifying conditions of the organisations where the work is performed. Enter these in the form’s employer fields. An accountant or tax lawyer can use your contracts and actual duties to establish the appropriate route and the source of the income.

How are Portuguese and foreign income taxed?

The 20% rate covers net Portuguese-source category A or B income from the qualifying activity. Other Portuguese income follows its applicable rules. You may elect aggregation under the ordinary IRS system. Compare the actual tax costs rather than assuming the special rate is always cheaper.

Qualifying foreign-source employment, business, investment, rental and capital-gains income generally uses exemption with progression. It can affect the rate on other income and still needs to be reported. Foreign pensions, category H, are outside this IFICI exemption. Income connected to listed low-tax jurisdictions can face 35% treatment.

A payment from overseas is not necessarily foreign-source income. For example, employment physically exercised in Portugal can be Portuguese-source even when the employer pays from abroad. Cross-border businesses, pensions, trusts and double-tax treaties need case-specific advice.

How do you register, and what is the deadline?

Apply through Portal das Finanças by 15 January of the year after becoming resident. For residence beginning in 2026, the ordinary deadline is 15 January 2027. The special 2024 rollout deadlines are not the continuing rule. A late application can use the remaining window from its application year, not a fresh 10 years.

The benefit runs within 10 consecutive years starting with the year you become resident. Prepare the following evidence for the application.

  • Employment contract, or the relevant research grant contract.
  • Current commercial registry certificate for a governing-body role.
  • Qualifications and, where required, evidence of three years' experience.
  • Company declaration establishing the activity and employer conditions. The authority may request additional evidence.
  1. Confirm your residence year and legal route with the employer or relevant authority. Resolve occupational and company-code questions before applying.

  2. Submit the IFICI request and supporting evidence through Portal das Finanças. Retain proof of submission and arrange the company's required confirmation.

  3. Check the result in your reserved area. AT says registration information is available by 31 March. Answer any request for missing documents within the deadline in that notice.

What happens after a job change or a gap?

Starting a new qualifying activity within six months of the previous one ending can preserve continuity. Report changes or loss of conditions by 15 January of the following year. A change of company or competent authority requires a new registration request. The original 10-year clock keeps running.

Benefits stop when the eligibility conditions cease to be met. They can resume within the original ten-year period once residence and qualifying-income conditions are restored. For a SIFIDE role, continued entitlement therefore depends on qualifying research work after the initial project ends.

Keep contracts, employer declarations and evidence of the work and income. Companies must retain the relevant documentation for 10 years. For the employer-confirmation deadline, AT’s FAQ for 2025 residents says 15 February, while article 4 of the regulation says 15 March. Confirm the deadline for your application with AT.
